The Criminal Record Certificate is the document that reports the definitive or final provisions in civil, criminal and administrative matters, concerning a specific natural person.

Who can request a Criminal Record Certificate?

The Certificate of Criminal Records, whether General, Civil or Criminal, can be requested only by the interested party (art. 24 TU) or by a person delegated by him (in the case of a minor or a person under interdiction, it must be requested by a guardian), provided that the person is in possession of a valid copy of an identity document and provided that the use for which the certificate is requested is explicitly indicated.

To request the Certificate of Criminal Records – General, Civil, Criminal – you just need to fill out the form by entering the following information:

  • full name of the data subject;
  • date of birth of the interested party;
  • place of birth of the interested party;
  • tax code of the interested party;

In order to carry out the service, once the order has been placed, the following documents are requested via email:

  • identification document of the interested party;
  • signed and completed proxy form of the interested party.

ATTENTION: In the absence of the completed proxy and the identification document, the service request cannot be taken into account. Pending such documentation, the service times are considered suspended until the complete receipt of the aforementioned documents.

What data does the Criminal Record Certificate contain?

Depending on the type of judicial certificate selected, the document contains the following information:

  • General Record Certificate: contains the interested party's data plus the information present in both the civil record certificate and the criminal record certificate, plus administrative offences and sanctions are also reported.
  • Civil Record Certificate: contains the data of the interested party with the judicial provisions in civil matters attributed to him/her relating to his/her personal capacity (interdiction, incapacity; administration of support, etc.) and any bankruptcies against him/her.
  • Criminal Record Certificate: contains the data of the interested party with the convictions and final sentences of criminal proceedings (so-called “criminal record”);

NB The Criminal Record Certificates are valid for 6 months. After this period, it will be necessary to request a new updated certificate.

When to request a Criminal Record Certificate

Requesting a Criminal Record Certificate is useful:

  • if you are an employer and want to know if a potential employee has a clean “criminal record”;
  • if you need to register for a public competition and you are asked for this documentation;
  • if you are to be hired by a public body and are asked to demonstrate that you have not had any proceedings against you;
  • if you want to know if a person has been interdicted or subjected to administrative support;
  • whenever you need to know whether a natural person has been subject to civil, criminal or administrative measures.
